Our holidays are meant to be the time of year that we look forwards to the most. We work all year knowing that we have a fantastic break to look forwards to, where we get to unwind, relax and do all the things that we’ve always wanted to, well this is how our holidays should turn out anyway, but what if you end up injured through an accident that was caused through negligence?
Having an accident abroad can completely ruin a holiday that has been planned for ages but if you have suffered an injury abroad, which has been caused by someone else you may be able to make a claim for compensation.
If you have suffered an accident that has caused one of the following then you may be entitled to make a claim for compensation:
• Road traffic accidents, whether you’re a passenger, driver or a pedestrian
• Boating accidents or cruise ship accidents and illness
• Gastric illness
• Food poisoning caused by poor sanitation; food or water
• Injury whilst taking part in a sporting activity or other recreational activities like diving or other water sports
• Injury whilst on an excursion
• Injury whilst on hotel/resort premises, such as a trip, slip or fall round the pool or on slippery or uneven surfaces
• Injury whilst in your hotel room
If you do have an accident whilst abroad on holiday then you will be able to pursue an accident claim whilst in the UK; however a personal injury solicitor in the UK will only be able to deal with your claim if your holiday was booked as a package holiday through a travel agent in the UK. In addition to this, your accident would need to be the fault of the travel agent or their representatives (e.g. hotel staff).
If you do wish to make a claim for compensation following an accident whilst on holiday abroad then it is important that you try and record and collect as much information and evidence as possible. This evidence could include photographs and details that have been collected from witnesses as well as information regarding any medical treatment as well as receipts for any injury related expenses. These are important as in a successful compensation claim you will be gaining compensation for not only your initial injuries but also for any loss or expenses you are facing.
When you have gathered information such as the above a solicitor here in the UK will assess your case for compensation in order to review the circumstances in more detail before a definite decision can be made about your claim for compensation.
